Terms of Service

In order to provide our Services (as defined below) through our website, we need to obtain your agreement to our Terms of Service.

TeDo Verlag GmbH („TeDo Verlag“, „our“, „we“, or „us“) provides the Services described below to you („Services“).

About Our Services

Privacy and Security Principles. Since we started our TechTalk Webinars, we’ve built our Services with strong privacy and security principles in mind.

Connecting You with Other People. We provide ways for you to communicate with other participants of TechTalk Webinars, e.g. through chat messages or questions in the Q&A section.

Safety and Integrity. We work to protect the safety and integrity of our Services. This includes appropriately dealing with abusive people and activity violating our Terms. We work to prohibit misuse of our Services including harmful conduct towards others. If we learn of people or activity like this, we will take appropriate action, including removing such people or activity or contacting law enforcement. Any such removal will be in accordance with the „Termination“ section below.

Enabling Access to Our Service. In order to operate our Services, we need to store content and information on Zoom and on our server.

Registration. If you want to use our Services, you need to register, using correct information, your current email address, and the name of your company. You agree to receive emails containing the registration link to our Services, whether from us or the platform we choose for our TechTalk Webinars.

Video Usage. When you view videos from us or from third parties through Open Webinar World, you authorize us to share information (mandatory account creation information) with that third party on your behalf. You agree that we may use your information for data analysis and that we or third parties may contact you for event-related or promotional purposes.

Age. You must at least be 16 years old to register for and use our Services, or such greater age required in your country or territory for you to be authorized for and use our Services without parental approval. In addition to being of the minimum age required to use our Services under applicable law, if you are not old enough to have authority to agree to our Terms in your country or territory, your parent or guardian must agree to our Terms on your behalf. Please ask your parent or guardian to read these Terms with you.

Devices and Software. You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply. In order to use our Services, you agree to receive notifications regarding our Services, as necessary to provide our Services to you.

Fees and Taxes. Registration to our TechTalks Webinars as participant is free. Providers have to pay a fee as listed in our price list.

Acceptable Use of Our Services

Our Terms and Policies. You must use our Services according to our Terms and policies. If you violate our Terms or policies, we may take action with respect to your account, including disabling or suspending your account. If we do, you agree not to create another account without our permission. Disabling or suspending your account will be in accordance with the „Termination“ section below.

Legal and Acceptable Use. You must access and use our Services only for legal, authorized, and acceptable purposes. You will not use or assist others in using our Services in ways that: (a) violate, misappropriate, or infringe the rights of TechTalks Webinars, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or instigate or encourage conduct that would be illegal or otherwise inappropriate, such as promoting violent crimes, endangering or exploiting children or others, or coordinating harm; (c) involve publishing falsehoods, misrepresentations, or misleading statements; (d) impersonate someone; (e) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, auto-dialing, and the like in Zoom or Teams chat rooms.

Harm to TechTalks Webinars or Our Users. You must not or assist others to directly, indirectly, through automated or other means, access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our Services, systems, our users, or others. This includes you must not directly or through automated means: (a) send, store, or transmit viruses or other harmful computer code through or onto our Services; (b) gain or attempt to gain unauthorized access to our Services or systems; (c) interfere with or disrupt our TechTalks Webinars; (d) collect information of or about our users in any impermissible or unauthorized manner; (e) sell, resell, or charge for our Services or data obtained from us or our Services in an unauthorized manner; (f) distribute or make our Services available over a network where they could be used by multiple devices at the same time.

Keeping Your Account Secure. You are responsible for keeping your device and your TechTalks Webinar account safe and secure, and you must notify us immediately of any unauthorized use or security breach of your account or our Services.

Licenses

Your Rights. TeDo Verlag does not claim ownership of the information you submit for your TechTalks Webinar account or through our Services. You must have the necessary rights to such information you submit for your TechTalks Webinar account or through our Services and the right to grant the rights and licenses in our Terms.

TeDo Verlag’s Rights. All contents, copyrights, trademarks, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services are owned by us and the respective companies or speakers. You must not use these contents, copyrights, trademarks, logos, trade dress, teade secrets, patents, and other intellectual property except with explicit permission. You may only use respective companies‘ contents with their respective permission.

Your License to TeDo Verlag. In order to operate and provide our Services, you grant TeDo Verlag the license to save your contact data and send them back to you in context of TechTalks Webinars, and also to pass on your contact information to companies whose webinars you attended in order for them to reach out to you. The rights you grant in this license are for the limited purpose of operating and providing our Service, such as to allow us to sending you emails regarding information about webinars that could possibly take your interest.

TeDo Verlag’s License to You. We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.

Reporting Third-Party Copyright, Trademark, and Other Intellectual Property Infringement

To report claims of third-party copyright, trademark, or other intellectual property infringement, please contact us at webinare@tedo-verlag.de. We may take action with respect to your account, including disabling or suspending your account, if you clearly, seriously, or repeatedly infringe the intellectual property rights of others or where we are required to do so for legal reasons. Disabling or suspending your account will be in accordance with the „Termination“ section below.

Disclaimers and Release

You use our Services at your own risk and subject to the following disclaimers: We provide our Services on a basis without any express or implied warranties, including warranties or merchantability, fitness for a particular purpose, title, non-infringement, and freedom from computer virus or other harmful code. We do not warrant that any information provided by us is accurate, complete, or useful, that our Services will be operational, error free, secure, or safe, or that our Services will function without disrupts, delays, or imperfections. We do not control, nor are we obgliated to control how or when our users use our Services or the features we provide. We are not responsible for and are not obligated to control the actions or information, including content, of our users or other third-parties. You release us and the referencing companies from any claim, complaint, cause of action, controversy, dispute, or damages, known and unknown, relating to, arising out of, or in any way connected with any such claim you have against any third-parties. Your rights to TeDo Verlag are not altered by these disclaimers if the laws of the country in which you use our Services do not allow such alterations.

Limitation of Liability

TeDo Verlag is only liable as follows: TeDo Verlag will exercise professional care in providing our Services. Provided we have acted with such reasonable care, we will not be responsible for any damage which does not arise from our breach of these Terms or otherwise from any of our actions, for damage which we could not reasonably have foreseen at the time we agreed to these Terms, and for events beyond our reasonable control.

Availability and Termination of Our Services

Availability of Our Services. We are always trying to improve our Services. That means we may expand, add, or remove our Services, functionalities, and the support of certain devices and platforms. Our Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our Services within a thirty days notice. Events beyond our control, including preventing abuse, reacting to legal conditions, or solving safety problems, may justify the requirement of said notice no longer applies. Further events beyond our control, such as natural events or events of force majeure, may influence our Services.

Termination. Although we hope you remain a TechTalks participant or provider, you can terminate your relationship with TechTalks anytime for any reason by deleting your account. For instructions on how to do so, please contact us at webinare@tedo-verlag.de.
Our right to terminate you for important reasons remains untouched. An important reason exists if one of the parties violates laws or the rights of third parties and if the terminating party, after weighing up all circumstances of the respective case and the interests of both parties, cannot reasonably be required to end the contractual relationship by the agreed expiry date or to the expiry of a period of notice. Termination for important reason is only possible within a reasonable period of time after the other party has become aware of the respective violation.
If the important reason relates to a breach of an obligation under these Terms and conditions, termination is only possible after a period of grace granted has expired or an unsuccessful warning has been issued. This does not apply, however, if the party in the breach of the contract seriously and definitively refuses to fulfill its obligations, or if, after weighing up the interests of both parties, it is determined that termination without notice is justified due to special circumstances.
We may also modify, suspend, or terminate your access to and use of our Services at any time for suspicious or illegal conduct, including but not limited to fraud, or if we reasonably believe you are breaching our Terms or causing harm, risk, or potential harm to create risks for us, our users, or others. We may also deactivate or delete your account if it does not become active after an account registration or is inactive for a long period of time. If you delete your account, or we delete or disable it, these Terms will terminate as an agreement between you and us, however, the following provisions will survive any termination or termination of your relationship with TeDo Verlag: „Licenses“, „Disclaimers and Release“, „Limitation of Liability“, „Availability and Termination of Our Services“, and „Other.“ If you believe your accout was terminated or suspended in error, please contact us at webinare@tedo-verlag.de.

Use of the speaker portal

Storage of your data. If you participate in our TechTalks webinars as a speaker and use the speaker portal on Open Webinar World, you agree that your personal data will be stored in our CRM system in connection with the webinar at which you are speaking and for further use. You also agree that we may store all of your files on Open Webinar World (logos, personal image, presentation documents, presentation image) in order to further utilize the data in the context of the webinar or your presentation and to make it available to you or our viewers.

Contacting you. We reserve the right to contact you or a different contact person named by you in the event of questions about your presentation data or if the required data is not provided. For this purpose, we use the data that you have stored in your profile.

Processing of the leads. As part of the webinar, you will receive the webinar registrations generated by us. After the event, you may generate further leads for your presentation via our video platform. These will also be made available to you after the webinar via your speaker access. If one of the viewers withdraws their consent to the further processing of their data, e.g. by deleting their account on Open Webinar World, you are requested to remove this contact from your database and not to contact them any further.

Other

  • Unless otherwise provided in an agreement jointly executed between you and us, our Terms of Service constitute the entire agreement between you and us relating to the TechTalks Webinars and our Services and supersede any prior agreements.
  • We reserve the right to determine in the future that certain of our Services are governed by separate Terms of Service, to which you may separately consent.
  • Any change to our Terms or your waiver thereof requires our express consent.
  • We constantly work to improve our Services and develop new features in order to make our products even better for you and our community. As a result, we may need to update these Terms of Service from time to time to accurately reflect our Services and features. We will only make changes if the Terms are no longer applicable or if they are incomplete.Once updated Terms become effective, you will be bound by them if you continue to use our Services. While we hope you will continue to use our Services, if you do not agree to our amended Terms, you must stop using our Services by deleting your account.
  • All of our rights and obligations under our Terms are freely assignable by us to any of our affiliates in connection with a merger, acquisition, restructuring or sale of assets, or by operation of law or otherwise. In the event of such an assigment, we will only transfer your information in accordance with applicable laws and, where necessary, we will ask for your consent. These Terms of Use will then continue to govern the relationship between you and the relevant third party. While we hope you will continue to use our Services, if you do not agree to such an assignment, you must stop using our Services by deleting your account after being notified of the assignment.
  • You will not transfer any of your rights or obligations under these Terms of Use to anyone else without prior written consent.
  • No part of these Terms will prevent us from complying with the law.
  • Except where otherwise set forth herein, our Terms do not grant any third party any preferential rights.
  • Our failure to enforce any provision of our Terms of Service will not constitute a waiver of rights.
  • If any provision of these Terms is held to be unlawful, void, or for any reason unenforcable, that provision will be deemed mortified to the extent it becomes enforcable, and if it cannot be made enforcable, it will be deemed modified from our Terms. This will not affect the validity and enforcability of the remainder of our Terms of Use, and the remainder of our Terms of Use will remain in full force and effect.
  • We reserve all rights not expressly granted to you by us. Certain jurisdinctions may give you certain rights as a consumer, and our Terms are not intended to limit those consumer rights which cannot be waived by contract. In addition, in certain jurisdictions you may have rights as a data subject. Our Terms of Use are not intended to limit any rights that cannot be waived by contract.
  • We always welcome your feedback and suggestions about TechTalks Webinars and our Services. However, you understand you are under no obligation to provide us with any feedback or suggestions and we may use your feedback or suggestions without any restriction or obligation to compensate you.
